WEEE & Batteries Regulations

Under instruction from the Environmental Protection Agency and the Department of Environment, Heritage and Local Government all exhibitors must produce proof that they are in compliance with the Waste Management (Batteries and Accumulators) Regulations 2008 (S.I. No. 268 of 2008) and the Waste Management (WEEE) Regulations 2005 (S.I. No 340 of 2005) amended by the WEEE (Amendment) Regulations 2008 (S.I. No. 375 of 2008).

These regulations require anyone placing EEE and/or batteries and accumulators on the market in Ireland to be registered with WEEE Register Society Ltd.

Some exhibitors may be exhibiting only and therefore, the obligations would not apply for that activity. However, such exhibitors, if placing EEE on the market in Ireland subsequent to the exhibition, must meet their producer obligations where applicable.

Below you will find information explaining more about who should be registered and also contact details for you to obtain further clarification. The Environmental Protection Agency will be present at the shows to check compliance and therefore it is important that you have demonstrated compliance with the Regulations and satisfy their enquiries.

Registration Process - WEEE and Battery Regulation

Who needs to register?
All producers of Electrical and Electronic Equipment.
"Producer" means any person who, irrespective of the selling technique used, including by means of distance communication.

  1. Manufactures and sells electrical and electronic equipment under his or her own brand
  2. Resells electrical and electronic equipment produced by other suppliers under his or her own brand
  3. Imports electrical and electronic equipment on a professional basis into the State
  4. exports electrical and electronic equipment on a professional basis from the State to another Member State of the European Union, or
  5. Distributes electrical and electronic equipment from a producer who is deemed not to be registered under the provisions of article 12(2) Waste Management (Waste Electrical and Electronic Equipment) Regulations 2005, with the exception of a person or persons exclusively engaged in the provision of financing under or pursuant to any finance agreement unless also acting as a producer within the meaning of sub-paragraphs (i) to (v);

Registration Process
The original and fully completed application form must be sent to the WEEE Register Society Ltd. with a cheque for the appropriate registration fee.
After approval the WEEE Register will issue a Certificate of Registration with a unique 5 digit registration number. This number will not change on re-registration and should be shown on all invoices, credit notes, despatch and delivery documents issued from 13th August 2005. Furthermore, you will need to take responsibility for a monthly submission of data to the WEEE Blackbox. The data required covers the amount and weight of EEE products placed onto the Irish market.

After registration with the WEEE Register Society Ltd., you must also join an approved compliance scheme, ERP or WEEE-Ireland, or be self compliant. The requirements for the latter can be found in the WEEE Regulations 2005 Article 16 and the Batteries Regulations 2008 Article 23.

For 2009:

€150

- if the turnover of EEE & Battery products is < € 150,000

 

€ 250

- if the turnover of EEE & Battery products is ≥ € 150,000 but < € 250,000

 

€ 500

- if the turnover of EEE & Battery products is ≥ € 250,000 but < € 500,000

 

€ 1,000

- if the turnover of EEE & Battery products is ≥ € 500,000 but  < € 1,000,000

 

€ 2,000

- if the turnover of EEE & Battery products is ≥ € 1,000,000
